On March 5th, 2025, the judge overseeing the OFA v. FDA denied the plaintiff’s request for a preliminary injunction to allow for compounded Tirzepatide, which means that, as it stands, the FDA's enforcement discretion will remain in effect until March 19th, 2025. However, there is a possibility that the OFA may appeal this ruling, which could impact the timeline for dispensing.
As a result, it appears that NextGenRx will not be able to dispense Tirzepatide after March 19th, 2025. We strongly recommend that you prepare for this stoppage by securing your medication refill as soon as possible (no later than: 3/13/2025).
What This Means for Our Customers:
- Immediate Action Required: We urge all patients to submit their refill request for Tirzepatide formulations immediately. Given the uncertainty surrounding the appeal process, it is crucial to act quickly.
- Order Fulfillment Timeline: Please note that we will not be able to refill orders for Tirzepatide after March 19th, 2025, unless we receive further updates from the courts.

On 02/11/2025 the FDA clarified their position on their intentions for enforcement discretion relating to the dispensing of Tirzepatide containing compounded injectables to allow dispensing until either 03/19/2025 or until the date of the district court’s decision on the plaintiffs’ preliminary injunction motion in OFA v. FDA whichever is longer. As such, NextGenRx will continue to dispense Tirzepatide containing compounded injectable medications until the later of 03/19/2025 or a date to be determined by the courts.
Our recommendation for you is to secure as much medication as feasible for you by ordering a refill of the number of vials you and your physician approve of by March 11th, 2025. We will likely be supplying these medications beyond this 03/19/2025, however, we are all at the mercy of the courts.
